Terms of Service

1. Agreement to these terms
These Terms of Service ("Terms") are an agreement between you (the business or person using the service) and QHT Clinic, India, the operator of QHT Messaging ("the Service"), available at chat.hairmedindia.com. By creating an account, paying for a subscription, or using the Service, you agree to these Terms and to our Privacy Policy and Refund Policy. If you use the Service on behalf of a business, you confirm you are authorised to bind that business to these Terms.
2. The service
QHT Messaging is a team inbox for WhatsApp Business. It lets a business connect its WhatsApp Business number through Meta's official WhatsApp Business Platform (Cloud API) and gives its team a shared workspace to receive, assign, and reply to WhatsApp conversations, send template-based broadcast campaigns, run automations and chatbots, integrate with CRM and payment tools, and view reports and analytics.
The Service depends on Meta's WhatsApp Business Platform. Your use of WhatsApp through the Service is additionally governed by Meta's applicable terms, including the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy, and the WhatsApp Commerce Policy. We are not responsible for changes, limitations, or outages of Meta's platform, including changes to conversation pricing, template approval, or messaging limits imposed by Meta.
3. Accounts and responsibilities
- You must provide accurate, current information when registering and keep it up to date.
- You are responsible for all activity that happens under your workspace, including actions of team members you invite, and for keeping login credentials confidential.
- You must notify us promptly at info@qhtclinic.com if you suspect unauthorised access to your account.
- You must be at least 18 years old and legally capable of entering into a contract to use the Service.
- You are responsible for the WhatsApp Business number you connect and for having the right to use it for business messaging.
4. Acceptable use
You agree that you will not use the Service to:
- Send spam, bulk unsolicited messages, or messages to people who have not opted in to hear from your business;
- Violate the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy, or any other applicable Meta platform terms;
- Send content that is illegal, deceptive, defamatory, harassing, or infringes anyone's rights, or market goods and services prohibited under WhatsApp's Commerce Policy or Indian law;
- Attempt to probe, disrupt, or gain unauthorised access to the Service, other customers' workspaces, or related systems;
- Resell, sublicense, or provide the Service to third parties without our written consent, or use it to build a competing product.
We may remove content, throttle sending, or suspend workspaces that we reasonably believe violate this section, and repeated or serious violations may lead to termination. Meta may independently restrict or ban WhatsApp numbers that break its policies; we have no control over such actions.
5. Subscription and payment
- The Service is offered on a monthly subscription of ₹1,999 per workspace per month, plus applicable taxes (including GST), billed in advance.
- Payments are processed by our payment partners (Razorpay / PayU). By subscribing you authorise the applicable charges.
- WhatsApp conversation charges are levied separately by Meta at Meta's published rates and are your responsibility; they are not part of the subscription.
- If a renewal payment fails or is not made, we may suspend access to the workspace until payment is received.
- We may revise subscription pricing with at least 30 days' prior notice; revised pricing applies from your next billing cycle after the notice period.
Cancellation and refunds are governed by our Refund Policy.
6. Suspension and termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access, with notice where practicable, if you materially breach these Terms, fail to pay, use the Service unlawfully, or create risk for us, other customers, or the WhatsApp platform. On termination your right to use the Service ends; data deletion after closure is handled as described in our Privacy Policy and Data Deletion Instructions.
7. Your data and our intellectual property
As between you and us, you own your data — your contacts, messages, templates, and other content in your workspace. You grant us a limited licence to host and process that data only to provide the Service and as described in the Privacy Policy. We own the Service itself: the software, design, and branding of QHT Messaging. These Terms do not transfer any of our intellectual property to you, and you may not copy, modify, or reverse-engineer the Service except where the law permits.
8. Disclaimers
The Service is provided "as is" and "as available". While we aim for high availability, we do not guarantee that the Service will be uninterrupted, error-free, or that messages will always be delivered — delivery ultimately depends on Meta's platform and the recipient's device and network. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Limitation of liability
To the maximum extent permitted by law, QHT Clinic will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunities, arising out of or related to the Service. Our total aggregate liability for all claims relating to the Service is limited to the subscription fees you paid to us in the three (3) months immediately preceding the event giving rise to the claim.
10. Indemnity
You agree to indemnify and hold harmless QHT Clinic and its team from claims, damages, and reasonable costs arising from your content, your messaging to end users, your breach of these Terms, or your violation of applicable law or Meta's policies.
11. Governing law
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or the Service is subject to the exclusive jurisdiction of the competent courts in India.
12. Changes to these terms
We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, notify customers by email or in-app notice at least 15 days before the change takes effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
